Introduction to Pathfinder Courts
The Pathfinder Court is an innovative procedure designed to address parental applications concerning child care arrangements. This initiative emerged from the “Assessing the Risk of Harm to Children and Parents in Private Law Children Case” report, which highlighted the detrimental effects of adversarial court processes on both children and parents, especially those experiencing domestic abuse.
How Pathfinder Courts Work
Under the new system, Judges will request information from agencies involved with the family before court the parents attend the first court hearing. A key component is the early and extensive involvement of Cafcass (Children and Family Court Advisory and Support Service), which will engage with most children early in the case.
Focus on Non-Court Resolution
Pathfinder Courts encourage parents to explore non-court options such as mediation to reach amicable agreements, when safe and appropriate. However, cases involving domestic abuse will be handled differently, with courts prioritising the safety and welfare of children before making any decisions.
Pilot and Rollout of Pathfinder Courts
The Pathfinder Court system was initially piloted in Dorset and North Wales. From April 2024, it expanded to South East Wales, and in May 2024, it reached Birmingham.
